In vitro fertilization mix-up: what should be done?


OK, I'm less snide now. I'm a moody guy!

There's a case in NY being reported about a couple who went for artificial insemination, and who later found out the wrong sperm was used. The husband is not the biological father.

What now? My first reaction is "don't mess with Mother Nature," but of course that's not going to happen, even if it should.

The child is healthy. The mother has a child, which is what they wanted. But of course it's NOT what they wanted. The parents are suing, I believe, for negligent infliction of emotional distress. But what does this mean for the child, when he or she finds out that the parents were so disappointed with him or her? Sounds like a "product liability" suit! But will the parents ever truly "accept" the child? Should DNA tests be done in the womb, or the petrie dish? Can they be?

I don't believe a court has EVER awarded damages for the birth of a healthy child. Birth control fails - too bad!

So many questions. What say you?

Whoa! This is a toughy! I would imagine that the parents probably dreamed of having a child who would be a genetic mix of both of them. Of course, that didn't happen, and therein lies the problem. I can understand the devastation and sense of betrayal on the parents' part, but I also wonder how this will affect the child. I certainly hope that the father's feelings towards the child won't be changed. The child may not have his genes, but surely at this point, they've bonded enough to the point where love would matter more than biology.
