Cashing Social Security check on same date of death.?


My grandfather died very early in the morning and later that same day his Social Security check came and my aunt, who did not have power of attorney, signed his name (in front of us) and deposited the check into his account. She knew she was getting some of this money after the Will was probated. Was this legal?

No. She committed fraud by forging his signature on the check. Even if she had POA,the check should have been returned to SS since your grandfather had already passed.
It says on the outside of the envelope that if the recipient has passed away,the check should be returned unopened to SS.
They will question how a deceased person was able to sign their check. She could be looking at some problems as well as those who witnessed her fraud.

Your aunt may have to pay this back plus interest and then some. They will eventually catch it. If anyone had Power of Attorney they could report it or you could report it if you want to cause trouble. I would just let it go and let the govt. find it.

It may not matter. The Social Security Admin probably went into the account and retrieved it. That is what they did with my mom's check, and she died on the 25th of the month.
