Trying to fill out ny probate forms; p-4 "Waiver of Process: Consent to Probate"? |
everything goes to dad. does this form state the four kids give permission to consent to waive the whole process and just probate will? boy that sure would be great and hopefully speed up the process. btw. how long is the process to probate a simple will like this? and are there different forms to fill out in stead of this massive amount of paperwork i am plowing through? thanks! By signing a Waiver of Process; Consent to Probate, you agree that there does not need to be a hearing before a judge before the will could be admitted to probate at which time it becomes fqr more difficult to contest. If you wish to contest any elements of the will or the naming of the executor, you should not sign the waiver. If all distributees (heirs at law, next of kin) sign the Waiver, there will be no hearing. |

Call the probate court in that county, and ask them if they have a file for that person, and ask how much money you would need to sen... The probate is the key to the whole thing, as it needs to be shown to banks, companies in which there are shareholdings etc so that they know that they are OK to release the assets to the executors... |
