Question about aggravated assault and lawsuits?


Let's say a guy named Bob wants to make some money, so he insults a guy name Tony for the sole purpose of trying to make Tony attack Bob so that Bob can sue Tony for personal injury damages.

Can Bob still make money this way?

No, Bob can't "make money," he can only recover his damages.

Since he will have to pay attorney fees, he will be a net loser even if he wins his lawsuit, so this would be a very stupid plan.

Yes, lawyers work on contingency, my friend. I know that; I'm a lawyer. Can you do math? Let's say Bob recovers 100% of his damages. Let us assume they are $10,000 in medical expenses, $2000 in lost wages, and $3,000 in pain and suffering (the jury will award nothing for pain if they suspect Bob planned the whole affair). Bob recovers a total of $15,000 dollars.

Bob has not "made money," he has just been made whole for his injury. Now he has to pay 1/3 of that amount to his attorney ($5000), in addition to reimbursing her for 100% of the expenses (with filing fees, court reporter fees for depositions, medical expert testimony, demonstrative aids, etc., easily $3000). What does Bob have left? $7,000. Less than the loss suffered. He can't even pay his medical bills with his recovery.

Change the numbers any way you want. Put Bob in a wheelchair for the rest of his life. He will still only recover his damages, and will have to pay a third of that to his lawyer. The more he is damaged, the more money he loses. It's not rocket science.

Like I said, a stupid plan.

Let me take a wild guess: You beat the tar out of some guy (Bob), and have convinced yourself that you have a defense to his claim because he was baiting you so he could "make money."

First off, you're delusional. As the Professor points out, you can't "make money" by getting beat up. Second, it's not a defense. Even if "Bob" was baiting you on purpose, you aren't allowed to beat him up.

Wake up and smell the coffee, "Tony"!!! You can't beat people up if you want to be a "cool guy." But you can if you want to be a jerk, get sued, and live in an 8 x 8 foot cement room. You pays your money and you takes your choice!
