I have a legal matter involving a contract.? |
I enterered into a written contract that allowed me use of a leased vehicle and an additionl monthly payment. The other party confronted me about seeing another person driving the leased vehicle. The other party has allowed many others to drive the car, when a friend allowed me to borrow their truck for about three hours,I loaned them the car. The other party said that I violated the contract but the contract does not discuss other drivers. The other party took the car back and said that they will also no longer make the monthly payment of the money that they have agreed to pay me. The other party is a personal injury lawyer and wrote up the contract. We entered into the contact 1 year ago and there has be several times that they have threaten to take the car or stop payment of the money owed. I feel that because of their legal position they are taking advantage of me. What can I do? If I understand your question correctly. You entered a contract that allowed you the use of a leased vehicle with the individual who leased the vehicle through the dealership. Who happens to be a personal injury lawyer. If your contract spells out absolutely nothing about any other drivers, then youre good and if they try to void the contract over other drivers then they are wrong and you can sue in small claims court for breach of contract. Next time have evry little detail spelled out in the contract before entering it Present your case at small claims court. If there is nothing in your contract about use of the car by others, you will probably win. Next time, don't sign any unusual contract without having a lawyer look at it first. IT depends on what type of person you are i obviously don't have the contract in front of me but read through it. and if you want to sue them get a lawyer to look at the contract and see what they can do for you |
