Questions about personal Law: ALL are yes or no?


1)Will a bilateral mistake always provide grounds for a rescission of a contract?
2) Will a mistake as to the identity of a party provide grounds for rescission of a contract?
3) Will a mistake as to the existence of the subject matter of a contratc allow rescisson of the contract?
4) When both parties are mistaken about sum inportant fact, will the parties be allowed to rescind the conttract?
4) Will a person who makes an innocent misrepresentation of fact while entering a contract be bound by the contract?
5) Does the wronged party in a fraud suit need to show actual injury?
6) Are agreements made under duress void or voidable?
7) Does undue infuences usually involve a threat?
8) If a person pays no attention to a misreperesentation, can that person with a lawsuit for fraud?

Yes to all of them.

(Though I'm a little uncomfortable to say #1 is "Always." Also, in your second number 4, it's "yes" unless the misrepresentation goes to such boundaries as to make it unconscionable. Number 7 - the only one I'm tempted to say "no" to - undue influence is usually improper persuasion from a trusted relationship - but when the other 8 are "yes," well... there you go.)

But I ain't a lawyer, just done a lot of work with contracts.
