how long does it usually take for a personal injury claim for lower back injury and whiplash take to complete? i was hit from behind by a lorry with my 9 yr old daughter company. the lorry is owned by a transport company in kent and have already offered a settlement for my car. the accident was on the 15th It can take a number of years depending on the injuries suffered. MINE took 7 years ahhhhhhhhhhhh Several years. With any injury claim the important thing is to establish the extent of any long term incapacity and the effect of that on future life, earnings, etc. YEARS HOPE YOUR NOT DESPERATE took me 3 years to get it sorted out had to wait for medical reports to assess how long the injury would affect me mine took 7 years, depends on how serious the injuries are plus other things. It can be sorted in 6 months if it is a small claim!!!!!! my bro in law had whiplash claim sorted in a few months About four months if it is pretty straight forward. My word of advice is not to accept a settlement too quickly though. It took two years for me . there are time limits for each aspect of the claim, make sure you keep the claim moving with the odd polite phone call and you could get it in 18 months it can take a long time...it depends on a lot of things who the claim is against what the circumstances of the injury were what effect the injury had on employment what sort of employment whether the record keeping of the injury or any criminal proceedings is easily accessible and sound whether there is any party (especially insurance companies) who are contesting amounts...all these facts and more must be shared and evaluated by all parties (or parties' representatives0 and must be done in writing, if the deliberation is taken to court then it takes time to prepare the case on both sides, then court time must be sought and and even then a clear decision may not be reached there is no improvement in the speed of liability claims with the advent of communication technology as it is still requiring written and direct verbal testimony to reach decisions.....cases such as back injury and whiplash are very hard to assess damages for because their severity varies greatly.......there are guidelines that are used however (so much for actual loss of limb , so much for loss of use of limb etc...) there are thousands upon thousands of such claims being investigated every day and every solicitors practise has a core amount of such cases among their clients. |
