Is just the simple possession of an old Military Police baton illegal in California?


My house was recently searched by police for something totally unrelated to the baton and they took it. The baton was mine in the Army and I bought it from the government when I left.

Yes, it is a billy club and its possession by anybody other than a law enforcement officer in California is illegal. (Pen C sec 12020.) The police were being nice in just confiscating it; theoretically you could have been arrested and, worst case, charged with a felony.

sounds crazy,,I would raise hell,,,,,,,,,,,no reason to take that its not against the law to own ,,or you could not have bought it when you left

I feel for ya,,thats BS,,,,,Sentimental value I'm sure

I would call the department and demand it back,,,fast before they lose it ,,,and if they don't give it back ,I would file a law suit

You have to call them up and ask why they took it. Explain your case. That's unfair and complete s**t.
