Sorry, don't know much about this?

when a country's soldiers are in a country do they have to follow the laws of the country they are in, or their home country...or international law.

i was just reading an article about the amnesty international in canada losing a case where they claimed that afghan POWs should have canadian charter rights and shouldn't be handed over by the canadian military to the afghan officials because they are known to use torture. of course that was rejected by the court because they aren't on canadian soil.

what laws say that the canadian military has to hand over the prisoners? are they international laws? please enlighten me. should canada feel obligated to prevent torture from happening even though they are afghan citizens and terrorists?
