You could be an unlawful enemy combatant?

Here is the definition of "unlawful enemy combatant" courtesy of the 2006 Military Commissions Act.

Sec. 948a.
1.(ii) a person who, before, on, or after the date of the enactment of the Military Commissions Act of 2006, has been determined to be an unlawful enemy combatant by a Combatant Status Review Tribunal or another competent tribunal established under the authority of the President or the Secretary of Defense.

The executive can now declare ANYONE an "unlawful enemy combatant" (those are the guys in Guantanimo Bay with no rights) citing unspecified criteria. Does anyone see this to be a gross violation of the Constituitional checks on the executive branch?

Why do you think Bush placed those men in Guantanamo Bay, because by doing so he was, in effect, able to keep them in a legal "black hole" beyond the jurisdiction of any other country and without the status of "prisoner of war" under Article 4 of the Third Geneva Convention. The "prisoner of war" status applies from detention to release or repatriation, its main provision is to prevent States from torturing prisoners, without it it would appear anything goes.
