Medical malpractice...HAHAHAHAHA?


ok,does medical malpractice ''really'' exist
when you have even a routine surgery,they make you sighn so many dislaimers stating that ''these are known complications of said procedure''

even though everyone knows that ''these things SHOULD NOT happen''

so,my question is
with the doctors covering their behinds so much
can anyone actually ever win a malractice case
except ofcourse,obviuos cases where the accidently took an arm..i know that would win..
but a less obvious injury??

do we the people have a chance against these incompetant cold blooded creatures!!
btw.if anyone can recommend a good lawyer in florida
id appreciate that!!

What kind of injury are talking about? If you do have an injury that is caused by neglect from your doctor you might have a case, BUT not all surgeries are not guaranteed to be complication free. You will always run the risk of something going wrong and remember doctors are human, too.

EDIT--The best way to get a good lawyer is to ask other lawyers who they would use.

yes because in court unless the victim is like crazy or something its the victim to the doctor

All the disclaimers in the world do not protect doctors against failure to diagnose & misdiagnosis failure prescribe proper medication or dosage, or the other examples you cite or any of a hundred other things they screw up. .

Umm...doctors, like all other human beings, are human and subject to error or mistakes.

waivers cover the known potential problems and you are simply stating that you are aware of these and armed with this information are chosing to proceed with the procedure.

Malpractice doesn't cover side effects and complications rather acts or omission in a negligent or malicious manner contrary to the standard procedure or known information.
