If a attorney agrees to mediation are they usually ready to pay the claim?

Not necessarily. Mediation is just a non-binding way to resolve a dispute if and only if the parties are willing. BTW- the attorney is not a party so the attorney wouldn't be paying any claim- only the party in dispute would or would not be paying.

usually it is done to see the possible likelihood of a trial. the person who is the decision maker for mediation is not always a judge, but many times is a retired judge. this gives them an idea of where they stand legally. it is also not binding. however, arbitration is binding.

i think they are just testing the waters, i would guess if you win in mediation, then they will offer a settlement
