Court Ordered Visitation?


What do you do if one parent constantly does not follow the court ordered visitation agreement?

My fiance and his ex gf have a 3 yr old daughter together. He has full custodial custody of her. They went to mediation but the mother is not even following what SHE suggested. She wanted more time with her daughter, but it's always some excuse as to why she can't get her daughter. Mom also has an 8 or 9 week baby. Last night was mom's night to have her. Her reason as to why she couldnt keep her was because "her bf was over, and plus she CAN'T take care of two kids at one time." That's excatly what she said. The first week after the court order was arranged she did great... but after that she does what she wants regarding her daughter. Her mom was suposed to meet my fiance this morning to drop the little one off, because he had to go to work... he waited for 15 minutes she never showed up or called. This situtation is not a one time occurance.. more to come....

At least 2-3 times a week she disobeys the order that SHE wanted. This would not be an issue if this happened every now and then, but this stuff is going on several times a week. My fiance is at wits end on this because he does not want to take his daughter from her mother, but her mom is just showing very little interest in her child. Daughter comes home crying that mommy screamed at her, or that mommy was mean to her.... what can be done?

Also my fiance does not work a 9-5 job... he works in demolition and is on a different site just about every day. His boss is getting angry because at the last minute he has to leave work to go get the daughter when mom says at the last minute she can't/won't do it. I try to help out the best I can, but I don't work a 9-5 job either.

Time to get a Lawyer to have the visitation agreement amended. The Mother sounds very irresponsible. Sorry to hear it is causing so much grief but somethimes this goes with the territory. Good Luck.

Well, it IS hard to have a 3 year old and a new baby. Been there, done that. She is probably exhausted and dealing with a three year old is very hard.

That being said, if she is not honoring the agreement, go back to court. That's about all you can do. Tell the judge that the terms of this one are too loose and it needs to be tightened up. What you should also do is plan your itinerary without her in it. That way, if she doesn't show up, it's no big deal.
