Mediation?


comunity mediation centre has sent me a letter informed me to attend a session.A guy seek their advice to solve a dispute saying that i dun wan to pay their car damages. i received their breakdown cost n i m shocked-cost so much! i think he out 2 cheat me. I delay the payment coz i checked wif my frenz 1st ,shld i juz pay him or report the matter 2 police.can anybody advice me wat the mediator does? is it worth it going there? thks.

1st its a rental car. 2nd he didn't get me any insurance. 3rd he asking me to pay "excess claim" damages, loss of income, fuel. guess wat i didn't get to use on my day of rental oso coz the accident happened in the morning :(

Although "David M", who says he's a mediator, is correct on most of what he says, he's wrong on what he has to say about evidence. Community mediation is not like court--the community mediator has no power to make anyone reveal their "evidence" to the other side. The other side isn't obligated to tell you anything he or she doesn't want to. Moreover, because mediation is confidential, any information revealed during a mediation is not admissible in court later, unless it is otherwise discoverable. If you have specific questions, you should ask the community mediation program--they are in the best position to answer your questions and respond to your concerns about mediation. Mediation is definitely worthwhile--it can help you communicate with the other side and work out an agreement without having to go to court later. Good luck!

you sound like a deadbeat and wouldnt pay anyway so why bother...repairs to cars are EXPENSIVE..if you doubt his price but are willing to pay have him take it to a repair shop you know and trust...but I bet his estimate is pretty close as most shops charge around the same

I'm a mediator. You have nothing to lose by going to mediation. Mediation is a method for parties to resolve their differences without going to court. The mediator does not force an agreement upon you and anything you say in mediation is confidential. Further, the mediator cannot be called to testify against either party in court. Your obligation is to attend the mediation in good faith and see if you can reach an agreement. That's all there is to it. However, there is another advantage to attending the mediation. The other person has to reveal his "evidence" to you. Even if the mediation doesn't succeed, the information gained may be very useful.
