Dropping domestic violence case in NJ? |
My boyfriend and I got into an arguement over him cheating on me I attacked him and he was trying to restrain me against him. I explained this to the prosecuter and he is refusing to drop the charges because of the black eye the police witnessed and the marks on my neck from that night. I told them what really happened and that I fabricated everything so he could get into trouble because I wanted him out of my life at that point. We have another mediation set up for about 2 weeks, what can I do to get them to drop the charges against my boyfriend? About all you can do now is to ask the judge to dismiss the case. It is a difficult situation, to be sure. The power to prosecute the matter is in the hands of the prosecutor alone. He or she has likely seen many hundreds of domestic abuse situations and in many of them one spouse/boyfriend/girlfriend or another has indicated that they are uninterested in proceeding forward. This could stem from such a wide range of situations including fear to forgiveness. As a result, the prosecutor is left with several tough choices. However, in the end, the police can only testify that they observed a bruise and what information you told them after the incident. A man who is a real man Would Not lay a hand of harm on a woman, ever. I don't know about NJ law, but in WA state, it's a mandatory 24 hr. cooling off time in jail for the person who attacked the other in a domestic violence case. |
