Dropping domestic violence case in NJ?


My boyfriend and I got into an arguement over him cheating on me I attacked him and he was trying to restrain me against him. I explained this to the prosecuter and he is refusing to drop the charges because of the black eye the police witnessed and the marks on my neck from that night. I told them what really happened and that I fabricated everything so he could get into trouble because I wanted him out of my life at that point. We have another mediation set up for about 2 weeks, what can I do to get them to drop the charges against my boyfriend?
Should I not show up for the next mediation?

About all you can do now is to ask the judge to dismiss the case.
You realize that filing a fabricated police report is a crime.

It is a difficult situation, to be sure. The power to prosecute the matter is in the hands of the prosecutor alone. He or she has likely seen many hundreds of domestic abuse situations and in many of them one spouse/boyfriend/girlfriend or another has indicated that they are uninterested in proceeding forward. This could stem from such a wide range of situations including fear to forgiveness. As a result, the prosecutor is left with several tough choices. However, in the end, the police can only testify that they observed a bruise and what information you told them after the incident.

I would recommend showing up for the mediation, if the prosecuting attorney will be present. In that way, he/she will not wrongly conclude that you are uninterested in the outcome or whether or not the charges remain intact. You may still yet convince the prosecutor of the truth about the incident. Good luck to you both.

A man who is a real man Would Not lay a hand of harm on a woman, ever. I don't know about NJ law, but in WA state, it's a mandatory 24 hr. cooling off time in jail for the person who attacked the other in a domestic violence case.
You need to show up for that other mediation. If you can, please talk with an attorney, or the PA (who apparently is on your side) about what to do.
However, again, no Real Man would Ever put a hand of violence on a woman, or child, etc. Ever. The fact that you have a black eye, and some marks on your neck, shows that he couldn't contain himself. Apparently you should get rid of the boyfriend anyway, you state he cheated on you.
Also, from now on, it's best for you to not lose your temper either like that. To keep yourself out of any more possible trouble. Take care.
