Workmans comp trial? |
i have a case that after almost 3 years is coming to trial,i reached settlement in feb to have the employer re-*** on it,and drag it threw mediation,were they dont even call thier own attorney back or show up, thier atty wants to settle it.they are going to try again in 2 weeksto get them to come,then the trial has to be posponed again cause they didnt do the depositions,cause they thought it would be handled this way now.were settling for 10grand+medical,but if it goes to trial ,im afraid im not even going to get that much cause the attrny fee goes up.will i get interest on the amount in the trial and what as far as court costs are they responsible for,..as is if i settle im only going to end up with8200. ,if i go to trial i dont want to end up with less than that considering that this has cost me a new job and ive allready lost that much in wages since this was supposed to settle in feb.im getting really frustrated on this.im allready about 15 grand in the whole now. im in mich Lots of luck whenever you go to trial you have zippo guarantee to win. Jury trials are a safer bet than a judge himself. I have heard two cases in jury duty and both times seeing scars and tears they got their money plus. Sometimes it is best to settle for what is offered lawyers jerk you around thinking you will give up as a tactic. I fought workmans comp. for 8 years and only got about $8000, but the worst of it is it really recked me emotionally with all the dragging *** stuff. I ended up with emotional scars from that crap, and them calling me a liar all that time. I ordered my own MRI cause nobody would,it showed the injury alright,but comp. said that MRI's show things that aren't there. Best of luck. Oh, and I went through 3 lawyers. |
