When a public entity reaches an impass with the Union what do they have the right to impose?


As Director of a Fire District we have been in mediation with the Firefighters for their contract. We have made our last best offer in which they rejected, and are now at impass. Does anyone know what we have a right to impose, ie; the last best offer, nothing, salary only.....????

You may impose nothing. If you're at an impasse, you must go to arbitration per the FLSA and state labor laws. Both sides will equally share in the cost of an arbitrator and the proceeding. The arbitrator will make the decision on the issue at hand and both parties will have to abide by it.

Arbitration can be costly for both sides. If you can't come to an agreement, then be prepared for a costly battle which can hurt both sides.

File a request for arbitration in the Labor Office so that the offers of the both parties will be negotiated for the most beneficial package.
