I can't find an attorney who is willing to take a legal malpractice case, called over 25 & NC Lawyer Ref.?


I have called the NC Lawyers Ref. and the State Bar. No one will take this case--stating they (lawyers) will not file a suit against another attorney out of professional courtesy. Who or where do I go from here?

There is usually no shortage of lawyers willing to take such cases. Maybe you have a poor case.

What are you trying to sue a lawyer for? You'll have to give more detail.

They will not feed off each other.

Call the atty generals office and press charges

file a complaint with the state bar association against the lawyer you have the problem with,.....

Not all, but most states have some sort of Attorney Grievance Commission.

As for 'professional courtesies' within a profession, it's simply a 'sounds good' excuse that they're incompetent. Basically, if they don't stand to make a few thousand dollars from the case, they're not really interested.

Good Luck! You might have to chalk it up to a lesson learned. If you aren't pleased with the results, you fire him. If you feel you shouldn't have to pay him because of his incompetence, you still fire him. But the issues are separate. You have to pay the bill and than file a claim with the ARDC. You have to state your case, convince them of billing errors, incompetence (practically impossible) egregious behavior like threatening, sexual advances, drunk in court, something like that. But your letter has to be extremely convincing using legal terms. Than the ARDC asks the lawyer to respond, you get to respond to his response, and than they decide if it warrants legal action. But they really do protect their own. And most of the people on the ARDC are tools.

Huh...we sue other lawyers all the time. I mean not if it is a friend or something (that would be a conflict) but we've no worries about suing other lawyers.

What is your case about...there may be another reason.

If it is a dispute over a bill, you can apply to the courts yourself to have the bill taxed.

If you feel he was incompetent or unproffesional, report him to the bar association.
I hate to be the one to say it but is it perhaps because you don't have a case?
