Our heat isn't working and the landlord said she will look at it tomorrow?



In the mean time its 59 degrees in here and I have a 2 week old baby and a 2 year old son. Is this legal?

Oh, she lives upstairs and has to walk into our basement, but she said wait till tomorrow. This is ridiculous

If you asked the landlord several months ago and they haven't done anything, then you have every right to get it fixed yourself and deduct the cost of the repairs from your rent.

On the other hand, if you just asked yesterday and the landlord told you tomorrow, I don't think that's unreasonable. So you have to bundle up for a day or two. You can't reasonably expect that everyone out there is going to drop everything on a moment's notice just because you don't have heat. Although I would ask them to please tell the HVAC company that you have an infant in the house. Usually that will bump up the priority.

I would also say that 59掳 isn't really that cold. It's only ~10掳 colder than what you should keep your heat on.

59 degrees isnt any sort of emergency, we keep it cooler than that here most nights,Its been down in the 40's and high 30'sa couple times at night here,I havent bothered to turn the furnace on for the season yet,just bundle up if it gets in the 40's and you'll be fine..they should have the heat fixed by monday or so,and a couple days coolness wont hurt you any, or the baby either,just keep it warm as you can and dry...I cant belive some moron suggested that 59 might be lethal,you go outside and play or whatever at 50-60 degrees all the time, why should it be any worse in the house.

Well, go stay at a hotel. I don't think tomorrow is unreasonable. I know you probably think you shouldn't have to go stay in the hotel because you pay rent, but realistically, it's not freezing and she said she will look at it tomorrow which means she will probably have a professional do it and she can't just get someone at the drop of a hat. She probably has someone that works on these issues for her but he/she may have been dealing with other tenant issues...


I don't think she's breaking any laws besides what you feel is convenient.

59 doesn't seem too bad to me but i can understand your concern about your baby and son. for the baby make sure that he/she is kept warm with perhaps extra blankets while sleeping and extra clothing such as baby cardigans or jumpers whilst awake - the same for your son and yourself. if you afraid of them getting cold during the night how about letting them sleep with you but be careful with the baby that you don't roll on it.
legal? i can't see why it would be illegal.
your additional details - i am assuming you know or think it is a simple matter but it may not be. she may in fact know that is beyond her to fix it. if it needs someone technical you may have to wait even longer than a day.
you could try going to see her to see if this is a major or simple problem. if it is say a matter of flicking a switch then i think she is being a bit unreasonable. perhaps offer to help her out if it is just this. think about asking if she has a heater you could borrow until it is fixed.
don't lose your cool as she has the power to make you wait longer and frankly i doubt there is anything you could do about it.
remember - more things are caught with honey..... good luck. i hate the cold too.

remember there are a lot of people who don't have any form of heating at all including clothing.

Bundle your baby and son up or go to a relative or friends house for the night, this is not ridiculous at all, there is no catastrophe or severe situation and if there was, I would give you the same answer.
Does your landlord have any heat?

im pretty sure this is not very legal; its inhumane conditions that your paying for. This can become very lethal towards your child. If you decide to stay there and sleep, cuddling helps keep you warm.

60 degrees isn't considered a cold weather emergency.
