My landlord ripped me off?


Without getting into detail my landlord is ripping me off $475 dollars out of a $775 deposit,what I want to know is is there anything I can do? I am in Iowa and if I can't does anyone have any good ways I can get this person where it hurts? Short of painting a billboard with SLUMLORD RIPOFF ARTIST and her phone # and address....any suggestions?

You said "without getting into detail", yet are looking for a case specific answer. First, I would definitely suggest adding some more details to help you get better answers.

According to Section 562A.12 of the Iowa Landlord Tenant Law: A landlord shall, within thirty days from the date of termination of the tenancy and receipt of the tenant's mailing address or delivery instructions, return the rental deposit to the tenant or furnish to the tenant a written statement showing the specific reason for withholding of the rental deposit or any portion thereof. If the rental deposit or any portion of the rental deposit is withheld for the restoration of the dwelling unit, the statement shall specify the nature of the damages. The landlord may withhold from the rental deposit only such amounts as are reasonably necessary for the following reasons:

a. To remedy a tenant's default in the payment of rent or of other funds due to the landlord pursuant to the rental agreement.

b. To restore the dwelling unit to its condition at the commencement of the tenancy, ordinary wear and tear excepted.

c. To recover expenses incurred in acquiring possession of the premises from a tenant who does not act in good faith in failing to surrender and vacate the premises upon noncompliance with the rental agreement and notification of such noncompliance pursuant to this chapter.

After reading the above, are you sure you're being ripped off? If you're positive-- you should seek true legal help (Yahoo Answers is awesome-- but some things are just to big for us here.) There's a good chance you'll just end up in small claims court and be awarded your $475-- if you are truly being ripped off.

Tell her that you wont pay unless she give you back your money. Try to make an egreement like she only has to pay half. Sorry, but you probably wont get any more than that!
