My landlord want me to move out 28th to clean, but my lease extended to 31st, what do I do? |
my lease expired June 30, I told her I won't renew, so she lease it out , starting Aug 1st. then in mid June, I found I will have to stay for July because of some uncertainity with my job, so she agreed that I can stay in July. but we didn't really sign an lease extension. she did said she may need to clean the apartment on 28th or 29th, and I told her I will try to move out by that date. I actually signed a new lease to move in on 29th, but the new landlord changed the term and policy week later after I signed it, so I was upset and canceled this new lease, so I have to look for another place again. I finally find another place which will be available only on 13th Aug. I plan to move out 31st July to find a temporal place to stay. Now my current landlord told me she will let people to steam clean the apartment, so I will need to clear out the apartment 28th of July. I am really scared: I don't like fighting, I don't even know how to argue. what can I do? When there is no lease in effect, the tenancy is month to month in most states. That means, you would be expected to lease the apartment for the entire month... not a fraction of it. You should contact a local tenant/landlord association, most cities have them, and ask about the law in your town. If it turns out that it's a month to month area, send your landlord a letter explaining this and telling her you cannot leave before the end of the month unless she compensates you for staying elsewhere. Its not unusual for landlords to do this if they want a tenant to leave early. Don't worry about it. She will have to go to court to legally evict you whether you have a lease or not. This will take at least 2 weeks court process time and a 30 day notice to vacate. Tell her you won't be able to move until Aug 13th and that your willing to pay the prorated amount for each day used. She cannot just move your stuff out without a court order and the eviction notice served on you by a law enforcement official. Good luck If you want to try to avoid a fight with her you could see about staying with a friend for a week or two. Maybe see about putting your stuff in storage for the time being. If you can afford to leave on the 28th negotiate a refund of 4/31 of the rent you paid and a FULL refund of your security deposit. Tell her she has to wait. It's your apartment until the 31st. |
