I want to take my neighbor's to small claims court...help?


Ok, I moved in to this quadplex a few days before Jan 1, 2006. In winter of 2006, some new couple moved into the end apartment (right next to me... Im #3, they are #4). At the time, they had one dog who started whining/barking all the time when they left. Left a nice note letting them know. They came home and started to encourage their dog to bark, and left a note on my car saying "if I had suggestion, let them know." I had hoped that would be the end of it... but unfortunately it went on for a few weeks, so I left another nice note with suggestions.
Then a month or two later (March 27, 2007), I left a letter with the landlord. Time went by without any change, so I tried being extra nice & respectful to the neighbors. No luck! The got a second dog, who whined even more than the first. I directly talked to the girl of the couple.
I tried to ignore it, leave the house more, stay only in the bedroom (which is where I basically lived for months cause of the noise), *continued*

Finally I left another note with them, and with the landlord. He repsonded that he didnt know it had gone on since last letter and will contact them. I let him know I will give him an update in 2 weeks .... 1 week later it got so bad I called the cops and filed a noise complaint (they had barked 3-4 hours straight late at night). Since owners werent home, the police left a note at my request. I sent the landlord another letter with my update in a few days.
Since then, nothing has changed... they still whine/bark and the neighbor has been spitefule (the girl actually is so spiteful she drives around the block to park where I was parked, backs into my parking space, has parked inbetween my car and my boyfriends motorcycle *he was in 1 spot, I was in the next spot and she parked inbetween*, she drags her groceries/purse along the back of my car)!!!
I want to move but it so expensive...Im going back to college in fall and paying for all bills on my own!

Many localities have noise or nuisance laws, which I would think they are violating. And your mention of landlord, leads me to think they are renters, and it would seem that such things would be reason for THEM to be evicted. Since they got a 2nd dog, after your first complaint.. that sure sounds deliberate. I am just not clear why they are not being penalized for the situation. A tape recorder should offer proof of continued noise levels.
By the way, I love your avatar (we have several cats). But our cats don't make noise and disturb the neighbors.

When you take someone to small claims court it is because they owe you money for something. Nothing in your answer indicates that they owe you money. You could possibly file a noise complaint with the police department if the barking is all night long, though I do not know the ordinances of your area so they may not be able to do anything. If she has damaged your property you could file a police report for that. If not then the only thing you can do is try to work it out with them or move. Especially if the landlord isn't doing anything.
