Where can I find a lawyer who will represent an non American citizen or an international student?


I am being evicted. But I am an international student and I have nowhere else to go. I have the money I owe. However, the landlord is not accepting my payment. He served me with a summons and said I must be out in 14 days.

I would like the chance to pay the balance and any other fees to stay in the apartment. But the management is being very uncooperative and unsensitive.

I would like to get a lawyer to give me advice, but no one will help me because I am not a U.S. citizen. What should I do?

You can probably handle this one yourself. Do you have a signed lease? If so what does it say regarding payment? Laws vary from state to state, but typically, if you haven't paid the landlord is required to serve you with a 3 day notice to pay or leave. If you have the full amount of the money they should take it if you are within the time frame of the notice. If you are not in the given time, or didn't have the full amount, they would still have to file a formal eviction complaint (usually with the clerk of the circuit court), and then the court will serve you another notice to pay or leave. If the landlord won't take the money, pay it to the clerk of the court. Then when your hearing with the judge comes up show him the receipt. Also, when you are served, there is usually an option to reply to the court and the landlord gets a copy. Write the court and tell them what the circumstances were that made you late with your payment. A good explanation, a reason of hardship, and proof of payment in full usually go a long way to winning your case. If you really feel you need a lawyer, ask an immigration attorney to recommend one to you that is versed in landlord tenant issues. You can also go to a law library and read up on your local eviction laws.

No one will help you just because you are not a US citizen? They can't do that. By law everyone is entitled to be represented. You are a student which means you're here legally so I don't see why no one will want to help you.

Use the money you have to get back to your country, then find a lawyer there.

Well, I know where I live and at our local university, there are many International Students and an organization to help the International Students. I would advise you to first ask at your university or go to the Dean's office as they may have a lawyer who works for the University and will do this for a small fee. Apartments want their rent paid in full by a certain due date and if you are new here there may be a language misunderstanding. If you are a repeat late payer of your rent, the landlord might be real aggravated. Ask him again! Bye!
