Landlord/Tenant PIT BULL DISPUTE - Please Help.... Arizona? |
Just started 12 month apt lease- I AM DISABLED and find there are pit bulls / rotweillers when I was told absolutely no viscious dogs around. My cerebal palsy makes me walk funny and I was even stalked twice by pit bulls (dogs not on leash but between me and their owners initiated cat-like ) I walk in a weird way & fear i will frighten a dog. Also I freeze becoming defenseless, I fear these dogs and feel I must leave. I think the manager broke our lease agreement when he stated there are NO dogs such as these allowed. It was discussed prior to signing lease. Now, after the fact, manager states some of these dogs were grandfathered in. I see baby pits around also & so wonder. This is extreme problem for my well being and plan to move tomorrow. I have been here 3 weeks only. There is no reason to be fearful of pit bulls or rotties. They are not in and of their selves "Vicious" dogs. They are breeds of dogs that have been taken advantaged of for their size and strength by criminals. if it was discussed b4 signing the lease then no u shouldnt have to be held responsible. there should be a rental information line in ur area. they help renters with advice and legall information on matters such as these. good luck. I would report them to the SPCA and the ADA and whoever would listen and I would sue them in small claims for the money to relocate. I would check In there insurance, I'll bet that shoul get them no one insures for those type of dogs. ok first u said "and find there are pit bulls / rotweillers when I was told absolutely no viscious dogs around" i personally dont like these type of dogs i fell they are dogs that can be TRAINED or ABUSED into being vicious. but the dogs themselves are not vicious unless they do something wrong. so by him saying there are no vicious dogs there he isnt lying there isnt vicious dogs there are pit bulls / rotweillers. You feel the same way i do that breed of dog is more prone to violence and moving out sounds like a great solution. But dogs also wouldnt attack you do to ur dissability. They will attack if u provoke them, they are trained wrong or abused. as for the lease thats a 50/50. he didnt lie but im sure he understood what u meant. it all depends on whats in the contract. hope this helps and good Luck see your social service director and if he cannot help you then tell your landlord you have to leave and if he doesnt agree to your terms then see a lawer You are in a tough spot if you do not have that in writing. But you may get relief with the ADA. Talk to a lawyer. |
