AIDS Workplace?


Under current labor laws and our Constitution, can the management of a facility fire a person with HIV/AIDS due to that individual having that disease.
Also, can people be required to work with people have AIDS, even against their objections?

HIV and AIDS is covered by the American's With Disabilities Act. They cannot be discriminated against in any way and people cannot refuse to work those who are positive or have AIDS.

While it is illegal to fire someone based on their health condition such as AIDS/HIV. In some states all employment is "at will", which means the employer can fire you without cause. In this case you would have to go to court to prove that it was specifically because you had AIDS/HIV that you were fired.

You can be required to work with someone who has AIDS/HIV if your employer requires it. You can always quit.

Management ABSOLUTELY cannot fire a person due to their having HIV/AIDS. This is a violation of their rights. People can be required to work with them in the sense that - no memo is sent out if a person has the virus - so you may never know about it. If you do know about it, you always have the option to leave your job and find another. You cannot violate this persons job because you do not want to work with them (again, discrimination). (Many lawsuits stem from these types of situations).

I don't think so. I would have to check the laws protecting groups in the workplace. I would assume that they are protected, although I'm not certain

I believe if health risks are involved then that may be the case. You would catch me working next to one in a knife sharpening factory.

i would quit----stay far---far away!
