Lower pay with no notice? |
Can boss lower pay without notice. That is having same positon from day one till now. Check was for $8.75 hour and went down on the next check to $5.85 hour. Can he do that. I did quit the job already after the pay was lowered without notice. Should I call him first and confront him, then go to labor board. What real protections do you have against unfair, unilateral actions by an employer? Unless you have a written employment contract that prohibits decreased wages or are protected by a labor union, you may be considered to be an "at will" employee, which could mean you are out-of-luck. You could check with a lawyer to see if your state or other jurisdiction has statutory or other legal protections against such conduct. You may also need to explore the possibility that the decrease in wages was a pretext for other possible illegal conduct. Did he want to fire you becuase you were too old, too disabled, too black, too female? In that case you may have a discrimination suit. Did he do this because he did not want to pay additonal unemployment taxes if you were simply laid off. He will tell the unemployment office that you voluntarily quit so his unemployment taxes would not be affected. You would need to discuss this with a competent employment lawyer to know for sure. This would be considered constructive firing in many jurisdictions, but you may have hooped yourself by just quitting rather than asking the boss first. Is it possible that it was a mistake? NO, ILLEGAL! Laws vary per state, a quick check with the labor board wouldn't hurt. It is legal in the state of Georgia. Bosses in my area have done it to retaliate against people that have put in a notice. Georgia Dept of Labor says they can only enforce minimum wage unless you have a written agreement with your employer. If you already quit, i wouldnt bother calling your boss. Did you ever ask your boss why your pay was lowered? I would contact the labor board. I am not sure if there is a law against that, but there should be. Good luck no,catch that thief. |
