I have a court date on the 28 of april, with Labor commission. I'm the plaintiff.? |
Defendent has to prove I did not work certain hours, which I did!!, we were sub-contractors.. Should I susubpoena one of the other companies employee's , who called me into thier office one day to acknowledge something that happen one day.?. I actually worked alone at nights shuttling trailers for this other company , and I got paid by my emplorer.. But, he's the one Im having trouble with!, We ( me and my emplorer at the time ) had a prior hearing about my pay with a commissioner from the Labor board, ad the defendent never showed, setting us up for a court date.. Commissioner told me I didnt have to subpeona nobody, however , I would like to know if anyone else has had this experience.. Assuming you are correct in that the other fella bears the burden of proof, you don't HAVE TO subpoena anyone. However, you would be wise to do so. One can meet his burden simply by his own testimony that you did not work certain days. In order to meet that, you will want to marshall the best evidence you can. Not merely more people to contradict each other, but better quality evidence. For instance, if you were supposed to move trailers, get evidence showing that they got moved. Well I would bring someone just in case because the courts are screwy and they don't care especially if you worked for a local company that's known and open to the public.. F--- the Judge and the Attonery get all your paperwork together and bring that person in for a witness!! Otherwise you'll get more money! You've been played! Go to the goole and look up the Lab comissioner law VS. the plaintiff you'll see other forbidden stories there. I wouldnt trust anyone in that courtroom including your attonery.. It's like being in space..without the externals of energy they engrgy is inside (The mind)-- Whatever you don't you lose or forget any any your documents! Trust me I'm Pre-Law-- Money talks Bu-- Shi-- walks..In your Attonery's eyes he's doing you a favor for being there without any causes-- |
