New Hampshire Labor Laws? Can they write you up for an excused absence?


I had an emergency dr's appointment today and had to leave work for it, and before they let me leave, I had to sign my 'verbal warning' for an unexcused absence, but I have a note and a reason, therefore, shouldn't it be excused?

Unless it was a pre-authorized FMLA absence they can. NH is an at will state. As a previous poster stated, either you have a habit of missing work, or they are very unreasonable. Either way it might be time for you to look for another job.

On the face it does sounds pretty Lame to me...
Then of course if you have been
making a Habit of it...????

It is extremely hard to answer a question

It should be, unless your office has a policy of going to a Doctor appointment with out prior warning. I take it that you made the appointment because you were sick, ( or maybe your Kid) what ever the case if you have a valid reason, ( excuse from a Doc) I wouldn't think they could write you up. Who said you had to sign the written warning? I wouldn't have and just said, this is excused and walk out.
They can't fire you unless your abusing the policy.

Yes they can. This is not a legal question but one of company policy.

It sounds unreasonable of them to write you up for this, but employers are given alot of leeway in this area. Your best bet would be to have a brief chat with a legal professional who deals in employment law or even an HR professional.

If you signed an employee contract when your employment began and your excused absence didn't violate your contract, then no, you shouldn't have the warning on your employment record. But, if you do not have a contract, they can pretty much do anything they want (set the rules). Especially if you are in an "at will" employment state. In an "at will" state an employee can be fired for any reason or no reason at all.

Dyan O: If she had refused to sign it, she would have been violating (that particular company's) policy. She could have required that they make a notation that she did not agree with but was signing the warning to comply with company policy only.
