The dfeh gave me the right to sue my company. What will the eeoc do?


I need a lawyer with nothing down. Labor related in Oakland CA. where are they located?

Good question. This is one which often confuses a lot of people.

Generally, state civil rights agencies and the EEOC have 'work-sharing' agreements, which means that the state agency and EEOC will not pursue an investigation if the other has already done so.

I'm assuming that you already filed with the EEOC or that the DFEH forwarded a copy of your complaint to the EEOC. If it's the latter case, you should double-check with the DFEH or the EEOC to ensure that your complaint was received.

Since the DFEH has given you your right to sue letter, the EEOC will likely issue you a right to sue letter. You should contact the EEOC to inquire about receiving your right to sue letter. Here's the EEOC's national hotline: http://eeoc.gov/contact.html

In terms of finding a lawyer, I don't know what "with nothing down" means. Do you mean a lawyer who doesn't want any money until after the trial or will accept a contingency fee? The only way you can find such a lawyer is to call many lawyers and ask them whether they will accept such an agreement.

The EEOC IS the DFEH in so many words. EEOC does not pursue your legal rights under the law. That is up to you. If you have the 'right to sue' letter then start calling attorneys and schedule a consultation.

You can only select an attorney from a face to face.
