Labor laws in VA?


Ok so my boyfriend quit his last job for one making almost double what he was. He told them monday that he was going to finish out his 3 day shift and wasn't coming back. He was suposed to get his paycheck on thursday last week. When he went to pick it up they said they had already mailed it. It is now tuesday and he stil hasn't received it. He called asking about it and they told him "that was a pretty calssy thing you did not giving a two week notice we'll see what we can find out" now they wont return calls or tell him anything. Mail around here going to the same zip code as it originated from normally arrives 1 to 2 days later. its been 4 now. I think they are trying not to give a check. are they allowed to hold a check like that? and how long qould you have to wait before filing a complaint with the labor board if they do? Please help! Our bills are due and no way of paying them ;(

call the labor board and make a complaint......they cant with hold a check. did you know that on payday they cant with hold the check from you either....example...some companies say we have a meeting and you will get it there....no they cant do that.......call and make a complaint....i would even call the police and make a report.

Unless you can prove they did not mail the check you don't have much of a case yet.

Additionally, you are assuming the check was mailed from the local store or office. It may very well have been mailed from a corporate office or payroll processing company.

Also, I hope you both learn something from this. It was a HUGE mistake to walk off the job like that. Without giving proper notice you can bet he will not get a good reference from that employer. You may be surprised how bad that can bite him in the but.

If the new job does not work out, walking off the job like that can cost him his unemployment check.

Next time you know how to do it right so you can pay your bills.
