Child labor overseas,.. is it legal?


I'm in school for accounting and need help in deciding which answer I will choose for a question in a test. I DO NOT NEED THE ANSWER, I just have a question about the question... The Question is:
You discover that your company is employing child labor overseas to manufacture its product. You understand, however, that in that country it's often necessary for children to work in order to make ends meet. You decide to ask the advice of your government representative. What ethical dilemma are you facing? I don't need an answer, as I've narrowed it down to Loyalty vs Truth or Whistleblowing.. I just need to know if it's legal for us to employ child laborers overseas to better understand the question. If it's illegal, it's obviously Whistleblowing.

My other thought is the question doesn't really tell me how loyal I am to this company... So I'm leaning towards Whistleblowing..

I notice in your example that although you say it is often 'necessary' for children to work, it says nothing about whether it is 'legal'. This is the main issue at hand.

Your (presumably US based) company must be in compliance with local laws governing child labor in the jurisdiction in which they are employed, and also be in compliance with any relevant international treaties to which the US may be signatory (like NAFTA and GATT).

I think the ethical issues are two fold:

First, more narrowly, at least be in compliance with the letter of the laws that apply.

Second, a broader issue, the company should decide whether it wants/needs to formulate a policy on child labor above and beyond the legal minimum.
