Can i file a mechanics lein in Tennessee on atv for past due parts, labor and storage fees? and if so, HOW?

Again im in the state of Tennessee and I repaired a friends atv for him after we agreed on price for parts and labor of 1000.00 (1/3 of the total value of the atv) I collected 100.00 from him 6 months ago and havent seen or talked with him since, (Therfore im charging $15.00 a day storage since date of last payment) we agreed on weekly payments which he has made only one. he wont return my calls and dodges me. I have been finished with this atv and it has just been sitting for 6 months. And yes he does own it outright, There is no outstanding loan on the atv.

I still have the 04 suzuki ltz400 in my possession. like i said im tallying up a $15.00 a day storage fee. as far as "Stupid Business" West VA., I have worked for several shops and NEVER EVER gotten nor seen any shop require 50% down on a work order before doing the work.

While you MAY have a verbal contract with affirmation, what you do not have a case for is recovery of a charge not agreed to within the contract terms

if you file for storage, you could jeopardize your entire case unless you can prove to the court that you had an agreement for such fees in advance.

you cannot rewrite a contract that exists without agreement of all parties to the contract.

You normally need to be a repair business with a licence to do business from the state.

Unless you have a written repair order with the cost and his signature authorizing the repairs you will be turned down for a mechanics lien.

You can try to collect by going to a small claims court and filing charges (which requires a fee from you)

In West Virginia we call that Stupid business.
Always get 50% down on parts and labor then if he/she walks
you have at least half of our money.
