I live in California, but the company I worked for is in Georgia -- what state's labor laws apply to me?


I live in California and was working for a company based out of Georgia. They let me go a week ago under some very questionable circumstances and have also violated at least two California labor laws in the way they dealt with my termination. I'm trying to determine whether Georgia or California labor laws apply to our situation. Any ideas?

Under further information I received from this poster, the employment relationship with the Georgia firm was one of Contractor. Therefore, based on the further information, this is not an employment law issue but one of contract law which must be heard in the home state of Georgia.

From the additional facts, the state of California has neither subject matter of personal jurisdiction.

Not sure, but did they happen to also break any Georgia labor laws? If so, you might have some ammunition either way.

Employment in a state outside of the area of influence, hence, your employment with a Georgia based firm. If you are located and based within the state of California your company has to be in compliance with the state of california labor code. it is a condition of their license issued to that company for doing business in the state and there are complaiance issues that they have to meet which meet or exceed the labor laws that apply to state citizens. File a wrongful termination suit in California for adjudication. The companies license will then become subject to recission based on unfair labor practice if found to be true.

Wrongful termination is an EEOC issue and it covers ALL states. See the link below. As to state specific laws, if Georgia has working people in another state then Georgia is bound by that state's specific labor laws.
