Labor Laws ??????????


Im am 17yrs old , Graduated , and i work about 63 to 70 hrs a week. My company has not been paying me overtime. I am in sales and my commision dose not exceed my hourly. This has been going on for about 5 months. and i am confused on my options, am i in title to punitive damages + all the overtime i worked.

In CA, you are entitled to your regular pay + overtime. If you are working for a company that pays commission OR pay based on time, as long as the commission exceeds what you would have made (time + OT), then that is all they need to pay you.

Contact your local labor board/commission and they will assist you in determining if you have a claim and help you file for wages owed.

As far as punitive damages, you'll be in a very difficult position to prove physical or emotional injury (since you still continue to report to work and haven't been committed or hospitalized).

Another option is to contact labor law attorneys, but it's going to cost you a pretty penny.

It depends on what state they each have differant labor laws. Check with your state laws online you should be able to get your answer there. What about your contract with the company what does it state, if you signed something without reading it that is a huge misstake look it over carefully.

Depends - are you salaried or absolute hourly? Is your overtime approved or are you working like this to increase your commission despite your companies objection to overtime.

Stop with the punitive damages - it's been 5 months, and you just got around to saying hey I'm missing 30 hours a check? C'mon - somethings not right there.
