California labor laws; rest and meal breaks?


if i work an 8 hour day, am i supposed to get two paid ten-minute breaks and a paid half hour meal break? or just the meal break?

Just like you said, unless you are in a union, 2 - 10 minute breaks (paid) and 1 - 1/2 hour lunch (unpaid).

512. (a) An employer may not employ an employee for a work period of more than five hours per day without providing the employee with a meal period of not less than 30 minutes, except that if the total work period per day of the employee is no more than six hours, the meal period may be waived by mutual consent of both the employer and employee. An employer may not employ an employee for a work period of
more than 10 hours per day without providing the employee with a second meal period of not less than 30 minutes, except that if the total hours worked is no more than 12 hours, the second meal period may be waived by mutual consent of the employer and the employee only if the first meal period was not waived.
The right to a net 10-minute rest period. You must be permitted to take a net 10-minute rest period for every four hours worked or major fraction thereof which to the extent possible shall be in the middle of each work period. If your employer does not provide you a rest period, your employer must pay you one additional hour of pay at your regular rate of pay for each workday the rest period is not allowed.

2 breaks and a 30 minuite unpaid meal break.

by California law you must receive 1 - 30 minute unpaid break if you work more then 5 hours (6 hours in entertainment)

no other breaks are required for 8 hours.
if you work 10 hours a second 30 minute break is required if the shift is less then 12 hours the second break may be waived if employee and employer agree.

by federal law no breaks are required unless you are a minor.

30 minute UNPAID break must be uninterrupted and completely free of work to be unpaid otherwise the break is paid for. breaks of less then 20 minutes are paid but are not required by any law.

I was incorrect on the rest period portion rest periods are not part of the code.

Beau is correct (1 - 10 min for 4 hrs) on the rest period it is not considered a break.

California allows numerous exceptions to the rest period ruling. depending on the job you very well may not be covered as far as a rest period is concerned. there are no exceptions for a meal break. so if you are just getting a meal break it very well could be legal, depends on your job.
