If an employer lays off an employee as a reduction-in-force does that mean that the position is no longer open?? If the position becomes open does the employer have to offer it to the employee who worked it last? Last Question- Can an employer lay off an employee as a reduction-in-force and then post that position as being open??? No, the position does not have to close, nor does it have to go to the last person who was in it. Usually, the person who gets it has previous experience in that slot or one like it and has seniority. Sounds like you just got taken advantage of. Find better people to work around... the correct spelling for labor is actually labour In my opinion, All Right To Work States Should be Banned! Texas is a Right to Work State giving few if any rights to workers! |
