California labor laws/late?


If I work 8.4 to 8.7 hours a day why is my company not required to pay me overtime ex. 8am-5:07pm whould this not be considered as overtime pay?. I do not get a start time grace If I am for instance not clocked in @ or before 8 am I am considered late.after 9 times in 6 mos. no mater 1 or 5 min. I will get a write up .If i work 5min over time for 5 days I don't get atleast 25min overtime for the week. Thank you

Are you required to work these extra minutes or are you just late in clocking out?

Unfortunately no you don't not for 7 minutes. The rule usually is 30 miutes or more over your 8 is considered overtime in California, I deal with it everyday.

They are required to pay you overtime. However, 8.4 hours would be 8 hours and 24 minutes, not 7 minutes. Anything over 8 in a day, or 40 in a week is overtime.

They are required to pay you OT, but a lot of companies expect that their employees are stupid & don't know labor law, and will try to skirt it if they can (I've held a number of retail positions in CA, only 1 was actually honest with its employees about labor laws.)

The best thing to do would be to file a complaint with the state labor board & let them come in and audit the company. The comapny will probably try to terminate you if you make it an issue with them. (I've seen them do this far too many times). As CA is an at-will state, they are allowed to do this.

Yes, I have very little faith in the large employers in CA.

If, however, you work for a smaller employee (I think small is now defined as less than 10 by CA) they may or may not be required to pay you OT for more than 8 hours/day. There are some exemptions to labor laws for small employers.
