If I work 8.4 to 8.7 hours a day why is my company not required to pay me overtime ex. 8am-5:07pm whould this not be considered as overtime pay?. I do not get a start time grace If I am for instance not clocked in @ or before 8 am I am considered late.after 9 times in 6 mos. no mater 1 or 5 min. I will get a write up .If i work 5min over time for 5 days I don't get atleast 25min overtime for the week. The rule usually is 30 miutes or more over your 8 is considered overtime in California, I deal with it everyday. They are required to pay you overtime. However, 8.4 hours would be 8 hours and 24 minutes, not 7 minutes. Anything over 8 in a day, or 40 in a week is overtime. They are required to pay you OT, but a lot of companies expect that their employees are stupid & don't know labor law, and will try to skirt it if they can (I've held a number of retail positions in CA, only 1 was actually honest with its employees about labor laws.)
