California labor laws?


can i be laid off while i'm in dr.s care for an injury.

i've only been working for the employer for 8 months.

Yes, FMLA doesn't apply to someone with only 8 months employment.

They can lay someone off for an business reason.

If your injury was not work related and did not make you disabled under state and federal law, they can even lay you off for being injured.

It's not a pretty world in the workplace!
Now let's get some of these laws changed!

You should be covered by the Family Medical Leave Act.

Ha ha ha ha ha. Even if it's not legal, they'll do it. You're the one who gets to hire the lawyer to get your job back.

My understanding is that employment in California is "at will". That means either party (employer or employee) can give the other notice at any time unless a contract is in place.

Yes, but NOT because of the injury...That might be considered "wrongful discharge". It may also depend on other factors. If you're an "at will" employee, they can let you go for any reason at all.
