Under indiana labor law is it legal for an employer to force you to use payed break time to use bathroom?


our boss gives us thirty minute payed breaks and has just recently told us me have to clock out everytime we use the bathroom using our payed time,also if we forget she threatens to take more time off then we should have been clocked out for(example) someone didn't clock out for full thirty minute lunch and she threatened to take a full hour when they were only short 8 minutes they should have been clocked out for plus this was payed time that did not run over)

US law prevents an employer from forcing an employee to work off the clock, so she cannot dock pay. She can discipline you for not clocking out for lunch for your full 30 mins but not through your wages. Report such violations to your labor board, or whatever Indiana has, there should be a poster posted somewhere on the premises. Indiana Department of Labor Voice: (800) 743-3333

sorry shes way off base,, report the company to the labor board you can do this anomalously and they will investigate the situation,

I would report this to the labor commission. It's a health and safety issue. In other words, even if you do pop into the toilet and use it on your breaks and if you need to use it during work time, she is denying you that right.
