Does Employer have to pay for time worked? |
I work for a juvenile detention center. Recently, some coworkers had to take a juvenile to the hospital because she was having a severe asthma attack. The shift supervisor took the juvenile to the hospital along with another coworker. Because it was an emergency, they forgot to call our superintendent to let her know they may have to work overtime. In the end, they worked two hours of overtime. Now our employer is refusing to pay for the extra two hours they worked because they did not request the additional time with our superintendent. They have proof they actually went to the hospital and the time. Is it legal for our employer to refuse to pay them for the two hours of time? Thanks Whoever is refusing to pay is breaking federal labor laws and knows it. She probably thinks you are too stupid to know that and she can just screw you out of your pay. Contact the Wage and Hour Board of the Labor Dept. Since you didn't give your state, I can't give you their site. They are required by federal law to pay you for all time worked. If it is over 40 hours they are required to pay you time and 1/2. Don't let them screw you. yes, my mother gets called into work on emergency basis all the time with no notice, this was an emergency situation and there was no way to get approval ahead of time anyways, the employer has to pay them, your employer has a boss, find out their name and talk to them about it. I don't think employers have to pay for " unauthorised Overtime ", or else anyone could hang around for an hour after finish time if boss was not around and claim an hours overtime pay ! I suggest that you call the department of labor.. Correct me if I am wrong, but aren't the Juvi Detention centers run by the County you live in? Aren't they the same thing as Jails, only for kids???? I don't think they are privately owned!!! Anyway! So you had a kid with a severe asthma attack! THAT can is IS an emergency! Suppose, you couldn't get a hold of the superintendent right away! Let the kid suffer or perhaps die! Right! THAT would have looked REALLY GOOD for YOU, not to mention the COUNTY!!! Think of the Law suits the parents of the child could have slapped on you! If you will pardon my French! That superintendent is a jack--s! You did the right thing! I wonder what he or she would have done if it had been his/her child!!!?? When those kids are in detention, regardless of WHY they were there, it's the facilities obligation to make sure the kids have medical care if needed, and NOT f--t around looking for someone to say "YES, it's OK to take the kid to the hospital!! If this IS a County facility, go straight to the top and tell the sup's Supervisor what happened, AND you should get paid for the extra two hours you spent helping that child!! NOW! IF! this guy turns out to be another Jack--s, you have one other avenue to go to! THE MEDIA!!! I can't believe they are refusing to pay you for those two hours, it's not like it's a thousand dollars an hour!! Something else that's running through my mind! As one of you was the Shift supervisor, surely she had the authority WITHOUT the higher mucky mucky's PERMISSION to do the right thing!? |
