Is my case up for double Jeopardy? |
This july i was in traffic court for a reckless driving ticket. I gave my plea of guilty, and the Judge gave me a verdict. However, they were gathering my information. They saw that i was sixteen. They said that they would have to move my case to juvenile court. Since i was completely tried i, but on the error of the court it was mistrialed, was wondering if i could use double jeopardy. So a traffic ticket isnt a crime, right? It is only Double Jeopardy if the original CONVICTION stands. maybe, if the issue was criminal, not civil. Mistrial means the case will be retired, and this does not qualify as double jeopardy since the first trial was declared a mistrial (technically meaning you haven't had a trial at all). That's not double jeopardy, because you were given a retrial AFTER conviction. DJ prevents the government from trying twice to convict you Double jeopardy doesn't apply to traffic tickets.
