ChoicePoint disclosed juvenile records on a backgroundcheck. It breaks laws on juv records. Now what 2 do? |
What can be done to make Choicepoint close the juvenile records that should have been legally private in the first place..according to my state laws. Can they be legally liable for this since they gave out the information..which included date of birth and date of minor offense, so they had information for them to calculate the childs age and the state that this person lives in. They should be up to par with state laws too. What can be done to get ChoicePoint to get it off the report and maybe held liable for their illegal discloser? Go to their web site (http://www.choicepoint.com/) and, on the right side of the page, there is a section called "Reports About You". You can find out what information they actually disclose about you, and they will help you dispute it. It is illegal for the state to give out that information. It is not illegal for anybody else to research your background and discover it. Send Choicepoint a certified letter along with a copy of your report and advise them they need to remove your minor offense from your report. Choicepoint is just reporting what your state reported to them. You can try to sue them for damages, call an attorney and see if they'll take it on a contingency fee basis. As the one person said, no record is ever truly sealed or expunged...not in this day and age of the internet. ChoicePoint has no liability here, they're reporting the info they have. |
