Need a little legal advice?


I need help with a young client at work. He is incredibly upset. He is a juvenile 17 years old, at a lockup facility where i work. He is in here for many counts of assualt. He will have served his sentence in two weeks. However he is upset because when he gets out ther will be a girl who will find and contact him. He wants nothing to do with this girl. A year ago he slept with her(he was 16 and she was 13). Now he is scared that since he wants nothing to do with her, she will claim that he raped her when it was not that way. He says she is that kind of girl. Its got him so upset that he almost doenst want to leave. Now should she decide to press charges, what could happen to him? This is in the state of Arkansas if that helps.

You need to stay out of it as it is none of your business; this is something he needs to deal with on his own and could get in trouble at work for getting too involved with a client.

Caveat: I am not admitted to practice in Arkansas, and so this is general information only.

Your best and only advice to him should be to suggest that he contact his attorney. The attorney will know how to proceed in this case.

There may be a potential for a charge of statutory rape, and if the girl is harassing him, then there may need to be some civil protection orders entered. (The exact name of the orders varies from state to state)

Have him contact his attorney. If he doesn't have an attorney, then he needs to obtain an attorney.

This whole thing really disturbs me. If he is your client, as you say, you already know how to direct him. If you are working in the facility and he is incarcerated, you in no way should be giving him advice or taking sides with him against this girl.
You have jeopardized your job and your oath by doing so.

Can he get restraining order against her?? BEFORE release, Contact judge of last case for advise?? Suggest counceling before release to get head straight how to settle problems with this girl. I hope you get more answers, but rape evidence has has to be more then say so with physical evidence somehow. *mamatx

He could get prosecuted for statutory rape.

    Go back to the court that sentenced you and ask them why your probation officer hasn't been in contact and to press for a final disposition of the case.
