Intellectual property without copyright?


Hi,

I created a website and a product is sold on that website.

I never copyrighted the product or website.

However, someone decided to clone both the website and product.

Would this be grounds for an intellectual property violation?

Can I still get this guy shut down for this? I know this has to be illegal somehow! What argument can I use to get rid of him?

I am also able to prove that my website came before his. (My registration date came first)

Your work is covered by US copyright laws when it is in tangible form, as soon as it is saved to a hard drive, printed etc (and you are not required to put the copyright notice on your pages, some do just to grandstand), you can email his hosting provider and ask that any of your material be removed,

They will usually comply if they determine it is infringing to protect themselves (they are afforded protection under the law if they comply with infringement removal), if they do not help to resolve the problem they can be held liable also

It is possible if you can prove ownership of product and have verifiable proof. you should contact an attorney who practices in this field. The UNITED NATIONS may be able to assist you also.
