Can I sue my insurance company if they do not cover my vehicle that was in an accident? ? |
When I purchased the vehicle, the people at the lot made sure that I had full coverage. Now that I have had an accident with the vehicle my insurance provider says that she never added my vehicle to my policy. When you purchase a vehicle from a dealer, the dealer will not let you leave the lot without confirmation that the vehicle is covered by insurance. Looks like the seller had a duty to cover you with insurance, if that was part of the purchasing agreement. If she didn't then the responsibility should be there. The seller asked you to show coverage. The did NOT, and without WRITTEN authorization from you CANNOT add the car to your policy. Did YOU contact the insurance company to add the car? If you did not, you have been driving uninsured and have no recourse. If you did, you should have been sent a new 'Declarations' page for your policy that listed the car and a 'proof of insurance' card to keep IN the car. Do you have proof of having submitted money for the premium? (a Post Office receipt?) Do you have proof of their receipt of money for the premium? (a canceled check?) Whether they added the car or not is not the issue. The issue is did you pay the premium? If the premium is paid, they have to cover the policy. you should contact a lawyer for a free consultation on your rights. get the information from your dealer on the coverage that was in place when you purchased the car. The insurance company usually can decline to add your vehicle. You should have received info from the insurer that it was added within 30 days to your policy. Try to resolve this with a supervisor or administrator of the company. Check for any paperwork that shows you have this type of coverage.
