Emancipation ??? If anyone has any answers- I sure could use some help.?


My ex-husband is trying to emancipate our two children. The oldest is 21 and the youngest is 18. Although they are both of age he still has to pay child support, part of their college tuition, car insurance and health insurance. They are both full time students and cannot afford to be 'out on their own'. He simply does not want to have to help pay anything anymore and am at a complete loss as to where to go from here.

Well, as soon as both of my sons turned 18 the child support payments stopped. I wasn't aware that if they were in school payments would still continue. Couldn't your kids get a part time job on their time off from school?

I look at this way, he laid down with you and got you pregnant and there fore needs to do his part for thier WHOLE life. I am going through the same thing except it is backwards. I have to pay my ex hubby for my daughter. It is in the court papers that I have to pay until she is out of school. Her medical insurance, half of her car payments and half of her schooling, which I don't mind to do at all. If it is ordered in your papers that he is suppose to pay these and he doesn't, you can have him put in jail for failure of payment. Unfortantly it is possible for him to get it dropped if he takes it to court but by time that gets done, he will pay about the same as just helping with school and stuff. He will have to pay for a great lawyer in order to win which I don't think he would. It would be a good idea to have your kids get a small part time job lined up and maybe a few extra beds in your house (if there are not already) just in case he does take you to court. In my case, as soon as my daughter turns 22 the payments stop weather she is in school still or not. Also, if she decides to quit school before the age of 22, the payments stop as well. I hope this helped girl. You can always go up to your caseworker at the shild support office and ask what can be done, GOOD LUCK

Tell your husband good luck. If you aren't earning anymore then what you normally have, and your kids are still full time students then he has to pay. Trust me I know. My uncle is in the same boat. My cousin is 25 and he still pays child support on her. But she's going to school to be a doctor and has a year left. Regardless he'll have to take it to court and the judge will more then likely tell him to deal with it, he had the kids and it's his deal to pay for their education.

If they are 18 they are already emancipated. Child support is a different issue.

In many States a court can order child support continued past 18 so long as the child is in full time education. Basically, if he doesn't like it..... he can learn to put up with it.

He can go back to the court that ordered the child support and ask them to terminate it, and you get to argue your side as to why they shouldn't do so.

i don't understand... i think legally he doesn't have to pay anything now that they are both of age. He may have agreed to help at some point, but i think if it went to court, they couldn't force him to pay anything since they are legal adults. but i could be wrong...i'll be checking back to see what others say.

Tell your kids to do what a lot of kids do these days. Go out and get a part time job, pay for school themselves and live with you.
