I was miserably misrepresented by my labor union.What can I do? My employer continually claimed that I had not?


I left work on a workers comp stress leave. While still under the care of my employers medical clinic, waiting for an OK from the companies workers comp insurance, the Dr kept seeing me telling me that it was still on hold. After consulting a workers comp lawyer, and directed to other doctors for treatment. Before I did that though, my employer fired me, claiming that I had abandoned my job. I filed a grievance with the union, and they just kept on accepting postponements by my employer on the grievance. The employer kept claiming that they needed the paperwork backing my claim that I was ligitimately off work. I supplied the paperwork twice, and the Drs office said that they had faxed all the paperwork during the time in question. The union accepted the postponements until it was 11/2 yrs later, then told me that they had to drop it since I didnt supply the proper paperwork to the company. They all kept acting as if I had never got the paperwork for them. I am shocked, and really pissed off, please give me advice, I have about two weeks to legally file against the union for misrepresentation. I dont need the money, it is just the right thing to do

ok so if the employer claimed they never got the paperwork.. you need to sue them.. not the union..

Hire your own attorney and go after them. Maybe they'll think twice before putting someone else through this.

Well you should have also given the paperwork to the union as well. You were screwed over by the employer. I am not sure what happened with the union. Is there someone higher up in the union that you can talk to? Talk to them and ask them to assign a different person to your case. Other than that, I don't know who would help you for free. If you saw an attorney that will cost something. Also did you sign anything along the way that said that you would not take the employer to court? Arbitration is not the same thing. Another thing that you could try is to call the local bar association and ask if there is anyone that specializes in labor relations and that would take your case for free. I had one of those once, but it was because my unemployment was denied and they assigned an attorney to my case. I won.

You seem to have got a bee in your bonnet over this case, and if I can make a comment, it is not helping you health wise.
As a lawyer and given the facts as you have stated them in your question, my advise to you would be Drop It. This is one of those cases that is going to drain you dry financially and it will not do your health any good with the stress of it all. Trying to ascertain blame in this case, will be almost impossible to prove. I know that is not the answer that you want and that you would prefer that we all agree with you and give you lots of sympathy, but this is a classic case of not being able to fight city hall. Sorry and all that but this is one time when you should just let it go.
