So does anybody know how to go about enforcing spousal support?


Lets say that the court has ordered the man to pay his ex transitional spousal support for a minimum or six year. Now he is also ordered to pay child support and to buy a life insurance policy on himself for the benifit of the child. This man is not paying child support; he is going to wait until the limit is up and the division of child support takes action. He has no job, no ambition to get one.
What I want to know is, sure the div of child sup will go after him for the child support, but they say that they wont enforce the spousal even though they will collect it from him if he pays. How does one go about getting the spousal enforced? Also, how does one go about getting the life insurance enforced?

He survives off of his dad for one, but then he just got fired from his job so other then their selling their pot to make ends meet, I assume that he might just be making money under the table by doing odd jobs here and there. I know he is a dead beat and there isnt much I can do, but I appriciate the ideas!

You can hire an attorney and who will file a Motion For Enforcement, they can file it as a 'criminal contempt of court' action, and ask the court to order him to be incarcerated for up to 6 months. (Most states probably have laws allowing for jail for contempt of court.)

Usually by agreement the sides will agree to suspend the sentence if he starts, and continues to pay.

If you don't have any money to hire an attorney some will do this for you on a contingency, or you can try the attorney general, or the district attorney. If you hire an attorney you can also ask the court to order that the daddy pay your attorney fees (as long as they are reasonable it can be ordered.)

Do this as quickly as you can, you need to have money available to provide for the child. Each month that he refuses to pay support he is borrowing from his child.

File a Petition or Motion for Contempt, since he is ordered to pay and he isn't. Who knows if he doesn't pay they might throw him in jail til he does or threaten to do it if he doesn't pay his arrearages.

It sounds like the dead beat is really a dead beat in the literal sense; most likely litigation to enforce the divorce decree is your only recourse, consult with the lawyer who handled the divorce


You maybe in a tough bind: Does he have any assets or source of income? If no how does he live? You can go into court to enforce the court order on the life insurance policy but if he does not have the monies and is not fraudulent in hiding assets, not sure of your outcome will be, little jail time but that is not going to equate to you getting paid
