Questions about accident lawsuit.


A few months ago my dad was driving in the freeway, there was a lot of traffic and all the cars were pretty much stopped he was also stopped, this woman for some reason was driving very fast and didn't break on time and it hit my dads car ( it was a sienna 2001) it was total loss for my dads car.

My dad was also hurt on the accident so he found a lawyer to file a suit.

My dad was called in the lawyers officer yesterday he had a "proposal from the womans insurance. They were going to pay him $3000 for the accident thats is what the lawyer said, so it would be $1000 for my dad, $1000 for the lawyer and a $1000 for the doctor, keep in mind the doctor was much more than $1000.

Something sounds so wrong in there, it looks like the lawyer is not telling the truth about the amount they are paying, my dad lost the car and also got hurt from the accident, and will only receive $1000 after more than 6 months waiting for a response?!?!?!

If anyone can give us some advice on how to act, the lawyer said that if my dad doesn't want that total they can go to court, but the lawyer also said that if they lose my dad owns him the lawyer $20000.
Is $3000 what the insurances usually pay?
Please if anyone know what we can do to find out if the lawyer is lying.
My dad is going to talk to some people tomorrow I think it is the broker. And see if he can tell him the amount.

It's impossible to say what would be typical with the details you've given. It all depends on the injuries and how much time he was out of work, etc. Based on your description, it sounds like the person who caused the accident was completely at fault, but there is likely another side to the story. However, the car alone should be worth at least $5000, so it does seem like you're getting screwed. It may be worthwhile to contact the insurance company directly.
