Stolen property from work??? please help? |
my boyfriends company van was broken into and all of his personal tools were stolen. the company has insurance for the vehicle and the belongings in it. they said that they would compensate him but now are changing their minds. he cant work without his tools and they expect him to purchase a few thousand dollars worth of tools inorder to still work. hes heard of this happening before at his friends company and they had to pay him for his loss. whats the point of having insurance then? if this happend to the company vehicle shouldnt their insurance be responsible? what should he do? if a incident report was done and the owner of the company stated that he would be responsible for your b/f tools then I would address the magistrate court reference the owner of the company statement. If he said it orally I would file a civil suit for the amount of the tools against the owner that would also be in magistrate. I hope all goes well for you. From a lawyer. Technically, he could sue his company and probably win, but it wouldn't be a slam dunk. He would have to prove that his company was negligent in some way, and that their negligence was the proximate cause of it being stolen. For example, if they hadn't repaired a lock or something. Of course, if he says another thing they will probably fire him. If he a union worker he can file a grievance and possibly get somewhere. Also, it's possible that this is covered under his auto insurance, homeowner's insurance or renter's insurance. Make sure he has proof that his company is binded to compensate for the stolen property. If he does have him to continue to fight and have them to purchase a replacement if they don't want to pay for the stolen ones. In the meantime, he may have to buy out of pocket and if so get them to reimburse him. if he has an inventory of his tools then yes they are suppose to reimburse what they would be worth now, or the replacement cost. its better yet if he has receipts and pictures, without them its the company and their lawyers word against his. sad, but unfortunately true. It depends on company policy and what the insurance covers. ouch. tough break. contact a lawyer - if they are not going to be reasonable sue them for all their worth. no right sue them now all the money the owe you and then extra for not paying |
